This End-User License Agreement ("EULA") is between you ("End-User") and Eden Roye ("Developer"), not with Apple Inc. ("Apple"). The Developer, not Apple, is solely responsible for sumi and its content.
The Developer grants you a non-transferable licence to use sumi on any Apple-branded device that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. The app may also be accessed by other accounts associated with you via Family Sharing or Legacy Contacts.
sumi is a flashcard study app. We provide the app "as is" without warranty. We may update, modify, or discontinue features at any time.
You retain ownership of all flashcard content you create or import. You are responsible for ensuring you have the right to use any content you import into the app, and you must comply with any applicable third-party terms of agreement when using the app.
sumi pro is available as an in-app purchase. All purchases are processed by Apple and subject to Apple's terms. Refunds are handled by Apple.
sumi pro Monthly is an auto-renewable subscription at the price displayed in the app. Payment will be charged to your Apple ID account at confirmation of purchase. The subscription automatically renews unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription in your device's Settings → Subscriptions.
The Developer is solely responsible for providing maintenance and support for sumi. Apple has no obligation to provide any maintenance or support services for the app.
The Developer is solely responsible for any product warranties, whether express or implied by law. In the event the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the app. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are the Developer's sole responsibility.
You acknowledge that the Developer, not Apple, is responsible for addressing any claims relating to the app or your possession and use of the app, including but not limited to: (i) product liability claims; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
In the event of any third-party claim that the app or your possession and use of the app infringes that third party's intellectual property rights, the Developer, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such claim.
You may not use sumi to store, distribute, or share illegal, harmful, or infringing content. You represent and warrant that (i) you are not located in a region subject to a U.S. Government embargo or designated as a "terrorist supporting" region; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
To the maximum extent permitted by law, sumi and its developer shall not be liable for any indirect, incidental, or consequential damages arising from your use of the app, including data loss.
You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that upon your acceptance of these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
We may update these terms. Continued use of the app constitutes acceptance of updated terms.
